Silent Auction general terms and conditions

 

  1. This auction is open only to people aged 18 or over who unconditionally agree to be bound by the jurisdiction of the UK courts. Save for winning bids, no purchase is necessary.
  2. Details of how to participate in the auction form part of the terms and conditions.
  3. Bidders may bid for more than one lot but may make only one bid for each lot. You acknowledge that once Emperor has confirmed you are the highest bidder, you have entered into a legally binding contract to buy the lot you have bid for from Emperor.
  4. Bids must be above the reserve listed for the lot being bid for; be in pounds sterling; and be received by Emperor by 12 noon on 31st October.
  5. Successful bidders will be notified within seven days of the closing date of the auction.
  6. Late, incomplete, or corrupt bids, and bids below the reserve for the lot being bid for, will not be accepted.
  7. The successful bid for any one lot being bid for will be the highest bid received by the closing date. In the event that two or more bids equal the highest bid, the lot shall be awarded to the bid received first.
  8. Successful bidders must remit their payment for the relevant lot within 14 days of notification.
  9. In the event of Emperor being unable to contact a winning bidder within seven days of the closing of the auction, or of the payment not being received within 14 days of a winning bidder being notified, Emperor reserves the right to award the lot to the next highest bidder. Should there be two or more bids equalling the next highest bid, the lot shall be awarded in accordance with clause 7, above. Emperor reserves the right to carry on awarding the lot to the next highest bidder until the reserve is reached.
  10. If, for any reason, Emperor is unable to award a lot, Emperor reserves the right to withdraw the lot from the auction.
  11. The lots as described are available on the date of publication and are subject to availability.
  12. Lots are not transferable and there are no cash alternatives.
  13. Any voucher redemption related prizes must be used within the specified time frame and lots may be subject to their own separate terms and conditions.
  14. Events may occur that render the auction itself impossible due to reasons beyond Emperor’s control. Accordingly, Emperor may, at its absolute discretion, vary or amend the auction and the entrant agrees that no liability shall attach to Emperor as a result thereof.
  15. Emperor will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent but your contact details will be added to the Emperor database for updates relating to Emperor and Emperor events. Please mark your entry clearly should you not wish for your data to be used in this way.
  16. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this user agreement but this does not affect any right or remedy of a third party specified in this agreement or which exists or is available apart from that Act.
  17. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this agreement.
  18. Nothing in this Agreement shall limit or exclude Emperor’s liability for death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable), or for fraud or fraudulent misrepresentation. Neither party will be liable for any consequential, incidental, punitive, special or other similar damages.
  19. These terms and conditions are intended to be the entire agreement between parties but may be amended by Emperor at any time, by posting the amended terms on this site and such new terms will be deemed effective immediately.
  20. This agreement shall be governed and construed in all respects by the laws of England and Wales.
  21. Emperor is responsible for the publication of this auction and all legal notices shall be served by registered mail to Emperor Design Consultants Limited, Zetland House, 5-25 Scrutton Street, London EC2A 4HJ.
